Financial Administration Act
- Requires the President of the Treasury Board to establish and maintain a public, searchable online registry of debts or obligations owed to His Majesty by corporations, trust companies or partnerships, and claims against them, where $2 million or more was remitted, forgiven, written off or waived in whole or in part.
- Each entry must include the entity’s name and any business name, the amount, the type and fiscal year of the action, and the legal or other instrument under which the debt or claim arose and the Act under which it was dealt with. The President may add other information.
- The President may exclude information considered inappropriate to publish for reasons related to confidential, personal or sensitive information. The registry must identify which of those reasons applies to an exclusion.
- Debts owed to, and claims made by, Crown corporations are excluded.
- The registry must be established within 18 months after the new section comes into force. Its initial entries cover qualifying actions taken after that date during the fiscal year covered by the most recently tabled Public Accounts. It must then be updated within 90 days after each tabling of the Public Accounts.
Consequential and coordinating amendments
- Amends six tax-related Acts to allow taxpayer or confidential information to be provided for the purposes of sections 23 to 25.1 of the Financial Administration Act, including the new registry provision. These are the Income Tax Act, Excise Tax Act, Excise Act, 2001, Softwood Lumber Products Export Charge Act, 2006, Digital Services Tax Act and Global Minimum Tax Act.
- If Bill C-15 receives royal assent and its specified Digital Services Tax Act amendment comes into force before or on the same day as Bill C-230’s corresponding amendment, Bill C-230’s amendment is deemed never to have come into force and is repealed.
